Honest opinion. Let it be known that the following is all fact, no lies, and told 100% truth. My experience with John "Ranger" of Butthead Kennels.
In November, 07 I contacted this known kennel about purchasing a pup off of a specific litter. Everything went smooth on the phone, I sent him $300 thru paypal as a deposit. The depost is "non refundable", $300 is the minimum to reserve a pick. Well, I reserved 3rd pick male.
After a few days later, the spending bug hit me, and I sent him another $300 for another pup off a litter that was going to drop about 1 month after the first litter. Well about a week later and reviewing my funds I decided to roll the $300 from the 2nd pup to the 1st litter. So that is $600 given for one pup now.
Time comes for the litter to drop, and only 1 pup dropped which later passed r.i.p. The breeder told me I have a few choices. I can either get my money back in full or transfer to another litter. I tell him that I want a refund. But after talking to my wife and it being Christmas and all, we didnt want to take $600 bucks away from him at that time. So I call him back the next day and told him to roll the money over to the next litter.
The new litter drops, and enough females are born so everything is cool. I got moved up to 2nd pick female because of the 1st litter problem. All the picks had to be made when the pups turned 5 weeks. So I go over to his home to get some pics and video of the pups. I have my choice between two females. Well 1 female had a big overbite, and the other female was not able to walk normal.
This female couldnt even bend one of her rear legs. This female would walk then fall down, she would swing her leg outward.
I didnt make a pick, went home thought it over and later called him that I couldnt take any of the 2 pups. Because one had the overbite, and the other one with the bum leg. I asked for my money back, he agreed. But I told him to keep 50 bucks for all the trouble he went thru in showing me the pups and helping me get my other pups ears cut. He agreed and told me he would send me the money the next day. Cool right??
Now it's the next evening and no money in my paypal account. I call him and he tells me if I can wait till monday because that was when everyone was going to pay off their pups. Ok, it's cool with me. Now comes Monday, and no money in my account, no call, no emails from him. So I email him because it was too late to call. I ask him whats up with the money. He responds later that night that he could only give me $300 of the $600 back because of the "no refund" policy. He said he took the pup to the vet and the vet said that the pup just developed slow. So this is why he wont give me the rest of my money back.
After debating the situation with him, he has since given 425 of the 600. It's not the 175 i'm hurting over, it's the B.S. excuse as to why the full amount is not given in return.
The problem here is that he told me he would give me ALL of my money back. So I took his word for it and researched on the boards for another pup. I ended up dropping 2K on a pup. (btw, the pup is a freak).
Is this proper protocol on his behalf? I believe in the "no refund" policy, but I didnt back out the deal on my own purpose. I backed out only because the pups were defective.
I know I should have only purchased with a contract. But not having a contract is not an excuse for someone to F me over.
I guess $175 is enough to money to F someone over, and to lose future business with, and referrals. Excellent business move. Spend the $175 wisely.

Depending on what you want to use the dog for anyways, tell the guy you will take the dog with the overbite instead of what ever else he owes you. You already got back the majority of the $ right?
